These Terms of Service (the “Terms”) govern your use of Daybookly (the “Service”), operated by [Legal entity name], registration number [Registration number], [Address] (“we”, “us”). By creating an account or using the Service you agree to these Terms.
1 The Service
Daybookly is a subscription software service for beauty studios, private clinics and similar businesses. It lets a business create its own website with online booking on a subdomain of daybookly.com, manage services, specialists, schedules and bookings, and receive booking notifications.
Clients of a business book through that business’s site free of charge. They are not parties to these Terms; their relationship is with the business.
2 Your account
You must be at least 18 years old and able to enter into contracts. If you use the Service on behalf of a business, you confirm that you are authorized to accept these Terms for it.
Keep your account details accurate and your password secure. You are responsible for everything done through your account. Tell us at [Email] straight away if you suspect unauthorized access.
3 Free building, paid publishing
You can build and preview your site free of charge. Publishing the site on its public address requires an active paid subscription or access granted by us in writing.
4 Subscriptions, prices and payment
Prices are shown in the currency of your region. The price that applies to you depends on the country of your business and is shown on the Subscription page of your dashboard before you pay. Subscriptions are billed in advance, monthly or yearly, and renew automatically for the same period until cancelled.
Businesses in Europe and Canada: our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all such orders. Paddle provides all customer service inquiries and handles returns. Paddle’s Buyer Terms apply to the purchase.
Businesses in Ukraine: payments are processed by WayForPay; the seller is [Legal entity name].
Taxes such as VAT or sales tax may be added at checkout where required. We may change prices with at least 30 days’ notice; a new price applies from your next billing period.
5 Cancellation and failed payments
You can cancel at any time in your dashboard. Cancellation takes effect at the end of the current paid period; until then your site stays live.
If a payment fails, we will notify you and allow a grace period to update your payment details. If the payment still fails, your site is taken offline. Your data is kept so you can resume later, unless you delete your account.
6 Refunds
Refunds are handled under our Refund Policy, which forms part of these Terms.
7 Your content and your clients’ data
You keep all rights to the content you add (texts, photos, logos, prices). You grant us a non-exclusive licence to host, display and process it only to provide the Service. You confirm you have the rights to everything you upload and that your prices and descriptions are accurate.
You are the controller of your clients’ personal data collected through your site; we process it on your behalf and on your instructions, as described in our Privacy Policy. You are responsible for having a lawful basis for that processing and for informing your clients.
Do not collect health information, diagnoses or other special categories of data through the Service. Booking forms are designed not to ask for them.
8 Acceptable use
You must not use the Service to:
- offer illegal services or publish unlawful, misleading or infringing content;
- send spam or contact people who have not agreed to it;
- interfere with, overload or probe the security of the Service;
- access other businesses’ data or resell the Service without our permission;
- take payments from your clients through our payment accounts — payments for your own services must go through your own payment provider.
9 Availability and changes
We work to keep the Service available and secure, but it may be interrupted for maintenance or by events outside our control. We may improve and change features; if a change materially reduces what you pay for, we will tell you in advance.
10 Third-party services
Some features rely on third parties, such as Paddle and WayForPay for payments, Google for sign-in and Telegram for notifications. Their own terms apply to your use of them.
11 Intellectual property
The Service, its software, templates, designs and brand belong to us or our licensors. You get a limited, non-transferable right to use them while your account is active. If you send us feedback, we may use it without obligation to you.
12 Liability
The Service is provided “as is”. To the extent permitted by law, we are not liable for indirect or consequential losses, lost profits, lost bookings or lost data, and our total liability is limited to the amount you paid us in the 12 months before the claim.
Nothing in these Terms limits liability that cannot be limited by law, or your statutory rights.
13 Suspension and termination
We may suspend or close an account that seriously or repeatedly breaches these Terms, after notice where reasonable. You may delete your account at any time; see the Privacy Policy for what happens to your data.
14 Governing law
These Terms are governed by the laws of Ukraine, and disputes are resolved by the competent courts of Ukraine, without depriving you of mandatory protections of the law of your country.
15 Changes to these Terms
We may update these Terms. We will notify you of material changes by email or in the dashboard at least 14 days before they take effect. Continuing to use the Service after that means you accept the updated Terms.
